The Uttarakhand High Court has given a big relief to ex-servicemen in the reservation case in government jobs. The court has canceled the government order to give reservation to ex-servicemen only once. The court has ordered to give them the benefit of reservation in government jobs every time. The case was heard before the division bench of Senior Justice Manoj Tiwari and Justice Subhash Upadhyay.
Provision of horizontal reservation
Challenging the government order of 22 May 2020 in the High Court, former soldier Dinesh Kandpal had said that under an Act of the year 1993, there is a provision of horizontal reservation to ex-servicemen, dependents of freedom fighters and disabled people.
Not entitled to this reservation again
He told the court that it has been said in this Act that they will get reservation. It does not say that reservation will be available only once. On the basis of this ordinance, the petitioner termed the government order as unconstitutional and said that in the government order of the state government dated 22 May 2020, it was said that if a former soldier has got the benefit of reservation in a state government job once, then he will not be entitled to this reservation again.
Ex-servicemen facing huge problems
Due to this government order, the former soldier could not be entitled to reservation in any other government job in future. Due to this, the former soldiers were facing huge problems and they were being deprived of many opportunities.
